Law360, New York (May 04, 2010, 12:52 PM ET) -- A federal appeals court has affirmed a ruling denying attorneys’ fees to nonlead counsel in a consolidated class action accusing Citicorp Investment Services Inc. of misclassifying certain stockbrokers as exempt.
In a ruling issued Friday, the U.S. Court of Appeals for the Ninth Circuit held that co-plaintiff Nicholas Tchikovani was not entitled to attorneys’ fees given that attorneys for co-plaintiff Chad Throne had been appointed lead counsel and had independently secured a $5.75 million settlement with Citi.
