Law360, New York (June 02, 2010, 3:59 PM ET) -- Indirect purchasers accusing SmithKline Beecham Corp. of stalling the emergence of generic versions of the nasal spray Flonase are bearing down on the drugmaker, offering the court three broad classes for potential certification.
On Friday, the plaintiffs filed an amended motion for class certification, presenting Judge Anita B. Brody of the U.S. District Court for the Eastern District of Pennsylvania with a trio of potential classes based on alternate state statutes enabling the indirect purchasers to seek damages for alleged antitrust violations.
