FedEx Drivers Take Employment MDL To 7th Circ.

Law360, New York (September 10, 2010, 5:18 PM ET) -- Multidistrict litigation over whether FedEx Ground Package System Inc. improperly classified its drivers as independent contractors is heading to the U.S. Court of Appeals for the Seventh Circuit now that drivers in Kansas have appealed an August ruling in favor of the company.

Two notices of appeal were filed Thursday in the U.S. District Court for the Northern District of Indiana, where about 70 lawsuits had been consolidated for pretrial purposes. The drivers say they should be classified as employees under various labor laws, and seek...
