Law360, New York (September 22, 2010, 12:40 PM ET) -- Burger King Corp. has asked a federal judge to dismiss remaining bad faith claims in a consolidated class action brought by franchisees who say the company's $1 maximum price on double cheeseburgers violates franchise agreements.
In a dismissal motion Tuesday in the U.S. District Court for the Southern District of Florida, Burger King said the plaintiffs have done nothing but disguise simple breach of contract claims—which the court already dismissed once before—as bad faith claims.
