Ohio High Court Guidance Sought In Bayer Vitamin Suit

Law360, New York (October 04, 2010, 5:35 PM ET) -- A federal judge has pared down a putative class action accusing Bayer Corp. of falsely touting men's vitamin products as good for prostate health, and will ask the Ohio Supreme Court to decide if consumers have standing to sue under the state's Deceptive Trade Practices Act.

Judge Kathleen M. O'Malley of the U.S. District Court for the Northern District of Ohio handed down a memorandum and order Thursday partially granting and partially denying Bayer's bid to have named plaintiff George McKinney's suit thrown out.
