National Union Must Defend Antitrust Suit, Grocer Says

Law360, New York (October 05, 2010, 3:03 PM ET) -- Supervalu Inc. has asked a federal judge to find that National Union Fire Insurance Co. of Pittsburgh, Pa., must cover the defense costs of a putative class action that alleges the wholesale grocer conspired with a rival to inflate prices.

In a motion for summary judgment filed Monday in the U.S. District Court for the Southern District of New York, Supervalu asked Judge Deborah A. Batts to find that the antitrust action is covered by an umbrella policy with National Union.
