Law360, New York (November 04, 2010, 6:34 PM ET) -- The plaintiffs in a securities lawsuit accusing KV Pharmaceutical Co. of making misstatements and omissions amid widespread drug recalls have appealed a judge's decision not to allow them to file an amended complaint.
Attorneys for the plaintiffs notified the U.S. District Court for the Eastern District of Missouri on Monday that they are appealing the ruling to the U.S. Court of Appeals for the Eighth Circuit. The plaintiffs have already appealed a February ruling that dismissed their complaint.
