BofA Exits Call Center FLSA Action

Law360, New York (February 01, 2011, 6:31 PM ET) -- A federal judge on Tuesday dismissed Bank of America Corp. from a Fair Labor Standards Act collective action, but granted conditional certification to a class of employees against a call center that contracts with the megabank.

The roughly 200 prospective class members all dealt exclusively with BofA customer relations services at the call center where they worked, but the bank was not a joint employer of the class members, Judge Sean J.
