Law360, New York (February 02, 2011, 7:39 PM ET) -- A Smurfit-Stone Container Corp. shareholder has launched a proposed class action aiming to block rival RockTenn Co.'s $3.5 billion acquisition of the corrugated packaging manufacturer.
Shareholder John Marks filed the suit Wednesday in the Court of Chancery of the State of Delaware against Smurfit-Stone, RockTenn and a slew of Smurfit-Stone executives including CEO Patrick Moore and Chairman Ralph Hake, as well as Sam Acquisition LLC, a RockTenn unit created for the purpose of the merger.
