First American Fails To Nix Class In Title Rate Suit

Law360, New York (April 05, 2011, 1:46 PM ET) -- A Maine federal judge refused Monday to decertify a class of homeowners in a suit claiming First American Title Insurance Co. overcharged for title insurance policies on refinanced mortgages, rejecting the insurer's contention that the class representative was inadequate.

Judge George Z. Singal of the U.S. District Court for the District of Maine rejected First American's motion to decerify the class, including its argument that class representative Bernhard Loef was atypical because he had an Eagle policy rather than a standard policy.
