Law360, New York (August 09, 2011, 2:18 PM ET) -- Animal health products maker Thomas Veterinary Drug Inc. was hit with a putative class action made available in Illinois state court Monday accusing it of faxing unsolicited advertisements for its products in violation of the Telephone Consumer Protection Act.
In his July 28 complaint, plaintiff Shaun Fauley claims that the defendant, which also goes by Thomas Labs, sent him an unsolicited fax advertising pet eye drops in October 2006 that contained no opt-out notice as required by law.
