Law360, New York (August 26, 2011, 3:23 PM ET) -- A California federal judge Thursday partly granted a bid to dismiss a proposed class action accusing Arizona Beverages USA LLC of defrauding consumers by promoting its drinks as “all natural” even though they contain high-fructose corn syrup.
U.S. Judge Jeremy Fogel allowed the plaintiffs' fraud and deceptive advertising claims tied to Arizona Beverages' labels to stand, but found the complaint did not provide specific examples to support claims of fraud in the company's Internet advertising and "promotional materials."
