NY Judge Revives ERISA Claims In Bear Stearns MDL

Law360, New York (September 13, 2011, 10:34 PM ET) -- Former Bear Stearns Cos. Inc. employees on Tuesday won a bid to replead pension-related claims dismissed in January from their suit against the company and auditor Deloitte & Touche LLP, but former shareholders lost a chance to revive derivative claims.

U.S. District Judge Robert J. Sweet granted the former Bear Stearns employees leave to amend claims that the defendants violated the Employee Retirement Income Security Act by failing to preserve the company pension plan's assets when its financial health began to look grim.
