Law360, New York (September 26, 2011, 10:22 PM ET) -- Victims of a deadly stage collapse at the Indiana State Fair last month launched a class action against the state Monday in Indiana federal court, challenging its long-standing $5 million cap on liability damages.
The suit, lodged by the estates of three people killed in the Aug. 13 collapse, as well as three who were injured, claims the cap imposed by the Indiana Tort Claims Act violates the due process and equal protection clauses of the Fourteenth Amendment, as well as the state constitution.
