Law360, New York (February 01, 2012, 2:42 PM ET) -- A New Jersey federal judge on Tuesday denied Honeywell International Inc.'s motion to dismiss that would have torpedoed a worker's putative class action on Employee Retirement Income Security Act claims accusing the company of skimping on health care service reimbursements.
U.S. District Judge Dennis M. Cavanaugh rejected Honeywell's argument that the suit ought to be dismissed because the plaintiffs — Honeywell employee and health care plan subscriber Sherril Dunn and plan beneficiary Thomas Dunn — had failed to complete the available administrative appeals procedure.
