Law360, New York (June 21, 2012, 6:02 PM ET) -- Mississippi and Alabama on Wednesday asked the Fifth Circuit to overturn a federal district judge’s decision to remove three Louisiana parishes’ state law claims in the Deepwater Horizon disaster to federal court, arguing the judge is trampling on states’ rights.
In amicus briefs, the two states supported Iberia, St. Mary, and St. Tammany parishes' argument that federal courts lack jurisdiction under the Outer Continental Shelf Lands Act and other federal laws to bar prosecutions for penalties by the state.
