Judge Chides Attys, Nixes Class Bid In Office Depot OT Case

Law360, New York (June 27, 2012, 7:08 PM ET) -- A California federal judge on Tuesday criticized attorneys’ failure to comply with rules and deadlines while representing Office Depot Inc. employees in an overtime suit against the office supply chain, rejecting a bid to certify the proposed class.

U.S. District Judge George H. King struck down lead plaintiff Maurice McCullough’s motion for class certification, saying that the court gave the workers and their counsel numerous opportunities to properly and timely file a motion for class certification.
