Law360, New York (July 12, 2012, 6:34 PM ET) -- GlaxoSmithKline LLC on Wednesday said the Third Circuit has no authority to hear appeals in 10 personal injury lawsuits in multidistrict litigation over diabetes drug Avandia that were thrown out because of patients’ failures to promptly disclose medical histories.
When a lower court last year tossed the cases, it left the door open for refiling of claims, but the patients are worried the statute of limitations had run out by that time, effectively barring them from moving forward.
