Dow Chemical Can't Exit Urethane Antitrust MDL

Law360, Los Angeles (December 19, 2012, 6:51 PM ET) -- Dow Chemical Corp. lost its bid Tuesday to escape long-running multidistrict litigation brought by direct purchasers accusing it and other urethane foam makers of conspiring to fix prices, with a Kansas federal judge saying the plaintiffs had offered evidence of a conspiracy.

In his order denying summary judgment, U.S. District Judge John W. Lungstrum said the plaintiffs — chemical companies in the U.S. and Europe — had provided enough evidence “to allow a reasonable jury to find that a conspiracy existed in this case.”
