Alcon Can't Escape Oversize Drug Bottle Class Action

Law360, Chicago (March 19, 2014, 1:13 PM ET) -- An Illinois federal judge on Tuesday refused to throw out a proposed class action accusing eye care company Alcon Laboratories Inc. of forcing consumers to buy oversize bottles of prescription eye drops, finding that the plaintiff had adequately stated a claim under a state consumer fraud law.

U.S. District Judge David R. Herndon issued an order denying Alcon's motion to dismiss the suit, which was brought on behalf of Illinois residents who purchased the anti-inflammatory drug Nevanac or antibacterial medications Moxeza and Vigamox.
