Burlington Coat Factory Misclassified Managers, Suit Says

Law360, New York (May 05, 2014, 4:12 PM ET) -- Discount department store chain Burlington Stores Inc. stiffs its assistant store managers by misclassifying them as exempt employees and withholding overtime wages, according to a putative class action launched in New Jersey federal court Thursday.

The nationwide retailer routinely requires its Burlington Coat Factory assistant store managers to work over 40 hours each week in order to complete tasks including stocking, cleaning the stores, unloading trucks and more, while improperly classifying them as exempt from overtime wages, the suit alleges.
