Law360, New York (September 03, 2008, 12:00 AM ET) -- Ross Stores Inc. has agreed to pay $1.2 million to settle a lawsuit with current and former assistant store managers who claim the retailer misclassified them under federal labor laws and failed to pay them appropriate overtime wages.
Judge Maxine M. Chesney preliminarily approved the settlement and provisionally certified the collective class in an order Friday in the U.S. District Court for the Northern District of California. A final hearing, scheduled for Feb. 6, will need to take place before the complaint is dismissed.
