Law360, New York (January 22, 2009, 12:00 AM ET) -- AT&T Mobility LLC has won a fight to force arbitration in a class action accusing the company of breaching West Virginia consumer protection laws by automatically enrolling customers in a roadside assistance program.
Judge John T. Copenhaver Jr. of the U.S. District Court for the Southern District of West Virginia said Tuesday the case should be hashed out in arbitration and that the plaintiffs hadn't presented any reason to invalidate the arbitration provisions in their cell phone contracts.
