Law360, New York (April 06, 2009, 12:00 AM ET) -- Claiming that the plaintiffs' counsel in a proposed overtime collective action against Centex Homes Inc. improperly solicited potential opt-in plaintiffs, the defendant has moved for sanctions, including injunctive relief, against two Florida law firms.
Centex filed the motion for sanctions Friday in the U.S. District Court for the Northern District of Texas, where the putative collective action, which accuses Centex of misclassifying its field managers as exempt and failing to pay them overtime wages, has been pending since its transfer in August.
