Top Court Boots Petrobras Immunity Claims In $787M Suit

Law360, New York (October 03, 2011, 3:39 PM ET) -- The U.S. Supreme Court declined Monday to take on Petroleo Brasileiro SA's case asserting that Transcor Astra Group SA cannot bring a $787 million contract suit against Petrobras in the U.S. because the oil giant is controlled by the Brazilian government.

The court's denial of certiorari means Transcor can move forward with the suit in Texas federal court without worrying whether the Foreign Sovereign Immunities Act exempts Petrobras — which is partially controlled by the Brazilian government — from being sued in U.S. courts. The district...
