Law360, New York (May 11, 2012, 5:35 PM ET) -- A New York bankruptcy judge ruled Friday for a Hilton Worldwide Inc. unit in a dispute with bankrupt MSR Resort Golf Course LLC over a property management agreement, rejecting the debtor's claim that Hilton was equitably estopped from enforcing the deal.
MSR had sought a declaratory judgment that Hilton can't enforce so-called nondisturbance and attornment agreements that would give the company legal recourse for MSR's breach of the property management agreements because Hilton didn't disclose the NDAs in 2007 estoppel certificates.
