Law360, New York (August 02, 2012, 4:23 PM ET) -- A New York federal judge Wednesday dismissed Ostrolenk Faber LLP's breach of contract claim in a suit chasing $400,000 in allegedly unpaid fees from biotech company Unigene Laboratories Inc. for patent registration work, a case Unigene previously called a “transparent” attempt to head off an impending malpractice suit.
U.S. District Judge Harold Baer granted Unigene's motion for partial dismissal, agreeing with the company's argument that New York-based intellectual property boutique Ostrolenk had failed to prove any terms of a claimed fee agreement between the companies. Ostrolenk sued...
