Background Check Co. Says Defectors Took Secrets To Rival

Law360, Los Angeles (March 01, 2013, 8:01 PM ET) -- Background check company Sterling Infosystems Inc. accused two ex-sales team members of defecting to rival BDO Consulting and bringing along confidential information, including client lists, that they used to aid their new employer, according to a trade secrets suit filed Wednesday in New York state court.

Russell Scarcella and Scott Augustus betrayed Sterling by hand-delivering investigative records from subsidiary Bishops Services Inc. to BDO — even though their employment contracts had confidentiality clauses that specifically prohibited them from doing so, Sterling claims.
