Capital One Can’t Dodge Credit Card Fee Class Action

Law360, New York (November 15, 2013, 4:00 PM ET) -- Capital One (USA) NA must face a potential class action accusing the bank of deceiving customers about fees and conditions applied to the use of their zero-percent APR access checks, a Virginia federal judge ruled Friday.

Citing reasons argued orally in court, U.S. District Judge Leonie M. Brinkema allowed six claims against Capital One to continue, but tossed one claim alleging that the fees were a breach of good faith and fair dealing under state law.
