DC Circ. Breathes New Life Into Attorney-Client Privilege

Law360, New York (June 30, 2014, 10:24 AM EDT) -- ​The circuit court of appeals for the District of Columbia breathed new life into the attorney-client privilege by holding that documents concerning an internal investigation into possible government contract fraud were protected by the privilege.[1] The court held that the privilege applies so long as one of the "significant purposes" of the internal investigation was to obtain or provide legal advice, even if the investigation was conducted pursuant to a company compliance program required by federal statute or regulation, or internal company policy....
