Federal Insurance Must Defend A&F Securities Suit

Law360, New York (January 23, 2009, 12:00 AM ET) -- A federal judge has ordered Federal Insurance Co. to pay clothing giant Abercrombie & Fitch Co.'s costs in defending a shareholder derivative suit.

Judge Edmund A. Sargus of the U.S. District Court for the Southern District of Ohio on Wednesday granted a motion by Abercrombie for partial summary judgment that Federal is required to pay Abercrombie's costs as they are incurred.

The lawsuit dates back to 2006, when Abercrombie sued Federal for a declaratory judgment that Federal was obligated to cover its costs in the securities...
