Canada Powers Up Buyer Class Action Against Dell

Law360, New York (February 04, 2009, 12:00 AM ET) -- An Ontario court dealt Dell Canada Inc. a reeling blow Tuesday, rejecting a bid to dismiss a massive product liability suit by Canadian consumers in favor of granting class status to purchasers of allegedly defective Dell laptops.

Judge Joan Lax of the Ontario Superior Court of Justice certified a national class action on behalf of roughly 120,000 Canadians who own Dell’s Inspiron notebooks, favoring a single class proceeding to the thousands of individual arbitrations Dell said were mandatory.
