Law360, New York (May 05, 2009, 12:00 AM ET) -- Puma AG Rudolf Dassler Sport has accused rival shoe manufacturer K-Swiss Inc. of selling sneakers featuring a pattern that closely resembles Puma's trademarked “Formstrip” design.
In a suit filed Monday in the U.S. District Court for the District of Massachusetts, Germany-based Puma claims that the “Formstrip,” a stripe running along the side of a pair of shoes that flairs out at the bottom is a “nonfunctional, famous, strong and highly distinctive mark that is prominently displayed" on Puma shoes.
