Monsanto Sues DuPont Over Patent For Crops

Law360, New York (May 05, 2009, 12:00 AM ET) -- Agricultural giant Monsanto Co. has sued rival DuPont Co. for allegedly infringing a patent on herbicide-resistant genetically modified soybeans and corn.

The suit, filed Monday in the U.S. District Court for the Eastern District of Missouri, accuses DuPont and its subsidiary Pioneer Hi-Bred International Inc. of infringing U.S. Patent Number RE 39,247E, a reissue of U.S. Patent Number 5,633,435. The patent covers Monsanto's Roundup Ready soybean and corn technology, which makes the crops resistant to Monsanto's popular Roundup herbicide.
