ORAL ORDER: The Court, in light of the June 22, 2026 referral, (D.I. 20), and having reviewed the parties’ proposed scheduling order, (D.I. 18), hereby ORDERS that by no later than June 29, 2026, the parties shall file a new proposed scheduling order, which is consistent with Judge Burke’s form “Rule 16 Scheduling Order – Patent” up through and including paragraph number 16 (i.e., regarding the portions of the case schedule up to but not including the case dispositive motion stage of the case) and consistent with paragraphs 20-27 of Judge Connolly’s “Scheduling Order for Non-Hatch-Waxman Patent Cases in Which Infringement is Alleged” (i.e., regarding the portions of the case schedule from the case dispositive motion stage through trial). That new proposed scheduling order should include the following dates provided by the Court: (1) A Markman Hearing should be set for April 20, 2027, at 11:00 AM in Courtroom 2A before Judge Christopher J. Burke.; (2) The Pre-Trial Conference should be set for January 26, 2028 at 10:00 a.m. in Courtroom 4B before Judge Colm F. Connolly.; and (3) A Trial should be set to begin on February 7, 2028 in Courtroom 4B before Judge Colm F. Connolly. Ordered by Judge Christopher J. Burke on 06/25/2026. (sam)
