JPMorgan likewise did not make any New York state law claims in either its initial complaint, amended complaint, or briefing. D.I. 1 ; D.I. 125 ; D.I. 172 at 12. And whether the alleged misappropriation is "use" or "disclosure" does not change the analysis. Downstream business transactions are not misappropriation. Montway LLC v.
