Judge Richard G. Stearns: ELECTRONIC ORDER entered granting 247 Motion to Dismiss. The Supreme Court, in its decision Gunn v. Minton, No. 11-1118, found that state law legal malpractice claims based on patent issues do not arise under the patent laws of the United States, and do not raise substantial enough federal issues to justify the exercise of exclusive federal jurisdiction over state jurisidiction. Consequently, there being no diversity in this case, this court has no jurisdiction over plaintiff's malpractice claims and the case is dismissed for lack of subject matter jurisdiction. SO ORDERED.
