Order on Motion for Initial Scheduling Conference
DOCKET TEXT ORDER denying without prejudice 21 Motion for Initial Scheduling Conference. The parties' request for resolution of the issue of whether or not this case should be stayed will not be addressed in the context of a scheduling order. Defendants object to all scheduling dates proposed by Plaintiff and suggest the case should be stayed pending appeal of an adverse state court ruling. Plaintiff, on the other hand, seeks to move the litigation forward to avoid fraudulent transfer. These issues, as raised in the Attorney Planning Meeting Report [21-1], are factually and legally complex and require full briefing. Additionally Defendants' Motion to Dismiss for insufficient service is currently pending before the District Court 6 and addressing these matters may be premature. For these reasons, the parties' Motion for Initial Scheduling Order is denied without prejudice. If appropriate, within 14 days after the District Court issues a ruling on the Defendants' Motion to Dismiss, the parties may submit a stipulated scheduling order or, in the alternative, Defendants may file a Motion to Stay the litigation.
