MINUTE ORDER: Upon review of Plaintiff's 14 Motion for a Production Schedule, it is hereby ORDERED that Defendant Federal Housing Finance Agency complete processing of Plaintiff's FOIA request, Request No. 2025-FOIA-139, and release all reasonably segregable, non-exempt responsive material by September 1, 2026. That request was submitted nearly a year ago and Defendant placed the request on the expedited track. See Joint Status Report 5, ECF No. 12. In February, Defendant represented that it would complete processing of the request, which involves less than 1000 pages of potentially responsive records and produce nonexempt portions by May 15, 2026. See id. That date has come and gone, and Defendant still has not made any productions whatsoever. Defendant vaguely asserts that the review has taken more time due to the complexity of the exemption issues implicated by the request and a backlog of other requests. But Defendant does not support that explanation with any detail or substantiate it with a declaration from an agency official. Moreover, Defendant knew the size of its backlog and the general contours of the potentially responsive documents in February, when it represented that it would complete processing in three months. The court is unclear why the same conditions Defendant knew of in February have now consumed more than five months without the release of a single page. Defendant's representation that it anticipates completing processing by mid-September is not a reason to decline to enter a production order. Defendant made a similar representation in February, and the deadline it selected for itself passed without production or adequate explanation. The court will therefore use its broad equitable powers to hold Defendant to a court-imposed deadline of September 1, 2026. See Clemente v. FBI, 71 F. Supp. 3d 262, 269 (D.D.C. 2014).
