Order
ENDORSED ORDER: The Court advises the parties that an extension of any deadline set by the Court, the Federal Rules of Civil Procedure, or the Local Rules, may only be granted by the Court. While the Court appreciates when a party consents to the opposing party's desired extension during a Local Rule 3.01(g) conferral, such private agreement between parties has no force unless a proper motion for extension of time is filed with and granted by the Court. Thus, a defendant must move for an extension of time to respond to the complaint if it requires an extension. Furthermore, despite Local Rule 1.10(b), the Court prefers plaintiffs to promptly apply for entry of Clerk's default if a defendant fails to timely respond to the complaint. The Court may enter an order to show cause if a plaintiff fails to do so. Signed by Judge Virginia M. Hernandez Covington on 8/19/2026. (GSO)
ENDORSED ORDER: Counsel are directed to meet and confer, in person or by telephone, and by September 21, 2026, file a completed patent Case Management Report. After the patent Case Management Report is filed, the Court will determine whether a Case Management Hearing is necessary before entry of a patent Case Management and Scheduling Order. Signed by Judge Virginia M. Hernandez Covington on 8/18/2026. (DMD)
