MINUTE ENTRY ORDER: Minute entry for INITIAL CONFERENCE and MOTION HEARING before Judge Charles Eskridge on April 17, 2024. All parties present and represented by counsel, except Defendant Prime Ocean PBC not present. The Court addressed the scheduling and docket control order and the joint discovery/case management plan. Dkts 19 & 23. It was noted that an amended scheduling and docket control order will be entered if jurisdiction is retained, extending deadlines as requested. The request for protective order will also be granted. The Court addressed the motion to remand by Plaintiff. Dkt 12. It was noted that this action originated in state court in Dallas, was removed to federal court there, and was subsequently transferred to this Court. Plaintiff noted that Defendant Prime Ocean PBC is not the correct named Defendant, but was the original basis for venue in Dallas. It was noted that this could create venue issues if this action or any part of it is remanded. The proper Prime Ocean entity has yet to be joined. As such, no counsel has entered appearance or responded to the motion to remand. The Court noted that the motion to remand appeared to be directed towards the Noble Defendants, without specific argument as to Defendant Kosmos Energy LLC. It was further noted that, as presented, jurisdiction over at least Kosmos Energy was likely to be retained. Plaintiff was ORDERED to inform the Court by April 24, 2024, as to whether he desires to dismiss the case without prejudice and refile it in state court in Houston with the proper Prime Ocean entity named and address any later remand issues in that action. Decision on the motion was RESERVED. The parties should continue to confer in good faith regarding discovery and settlement.
