STIPULATION AND ORDER OF DISMISSAL WITH PREJUDICE AS TO DEFENDANT THE NORINCHUKIN BANK PURSUANT TO FED. R. CIV. P. 41(a)(1)(A)(ii): IT IS HEREBY STIPULATED AND AGREED between Plaintiff Bay Area Toll Authority ("BATA") and Defendant The Norinchukin Bank ("Norinchukin") that all of BATA's claims asserted against Norinchukin in the above-captioned action are dismissed with prejudice, in accordance with Federal Rule of Civil Procedure 4l(a)(l) (A)(ii), without interest to any party and with each party to bear its own fees and costs. For the avoidance of doubt, this dismissal applies only to Norinchukin and not to BATA's claims against other defendants in this action, which BA TA is continuing to pursue. Additionally, nothing in this Stipulation is intended to waive or forfeit any rights BATA may have, or any recovery to which it may be entitled, in connection with the settlement between Norinchukin and the "OTC Plaintiffs" in Mayor and City Council of Baltimore v. Credit Suisse AG, et al., Case No. 11-cv-5450 (NRB), and related putative class actions that have been consolidated with Case No. 11-cv-5450 and are currently pending in the above-captioned multidistrict proceedings.
