Minute Order. A pre-motion conference was held on September 3, 2026 before Judge Margo K. Brodie to discuss the anticipated motions to dismiss by Defendants 286 Power Authority of New York, 297 Hess Corp., Texaco, Inc., and Union Oil Company of California, 300 Metropolitan Transportation Authority and the New York City Transit Authority, 301 Astoria Generating Company, L.P., and 302 Beazer East, Inc. Bradley Scott Rochlen, Ann Helen MacDonald, and Sonul Rao appeared on behalf of Plaintiff; Mary Rose Alexander and Nathaniel Lawrence Glynn appeared on behalf of Defendants Astoria Generating Company, L.P. and Beazer East, Inc.; Jonathan Racuhway appeared on behalf of Defendants Hess Corp., Texaco, Inc., and Union Oil Company of California; Charles Stanley Warren appeared on behalf of Defendants Power Authority of the State of New York; and Adam Kirschbaum and David G. Mandelbaum appeared on behalf of Defendants New York City Transit Authority and Metropolitan Transportation Authority. The Court heard oral argument from the parties and, for the reasons stated on the record, the Court finds each pre-motion conference request without merit.
