TEXT ORDER: The Court has reviewed Third Party Defendant Hoopaugh Grading Company, LLC's (Hoopaugh) 141 answers to the Local Civil Rule 26.01 Interrogatories, and determines the answer to Interrogatory H to be unresponsive in that Defendant fails to provide information necessary to determine the citizenship of Defendant which is a limited liability company ("LLC"). Citizenship of an LLC is determined based on the citizenship of its members, not based on a state of incorporation and principal place of business. See General Technology Applications, Inc. v. Exro Ltda, 388 F.3d 114 (4th Cir. 2004). Additionally, Hoopaugh's response to Local Civil Rule Interrogatory 26.01(C) is incomplete. Therefore, Hoopaugh shall file amended answers to the Local Civil Rule 26.01 interrogatories to include a complete response to all subparts of Interrogatory 26.01(C) and a fully responsive answer to Interrogatory 26.01(H) no later than October 2, 2026.
