TEXT ORDER: The Defendants move (ECF No. 214 ) to undo various orders entered by United States Magistrate Judge Waldor. The motion is denied. Against the backdrop of longstanding discovery delays and failures, costs incurred as a result, and explicit admonitions and even warnings, Judge Waldor exercised her discretion to issue sanctions. These sanctions were based on ample notice, and were both closely tailored and carefully thought through --- sanctions, for example, were not awarded as to certain requests, and Judge Waldor readily granted reconsideration where doing so was, in her judgment, appropriate. The Court has closely reviewed the record here, including the detailed and very good briefing supplied to the undersigned by the lawyers on both sides. The Court concludes that there was no error in Judge Waldor's various determinations here, especially given the deference she is owed and her palpable immersion in the details of this case. The Court declines to make an award to the Plaintiff for the expenses associated with opposing the instant motion. As the Defendant notes, an "undertaking of this size invites human error." There was none here, but parties should not be unnecessarily dissuaded by the imposition of costs from seeking error correction, and here costs are not warranted.. So Ordered by Judge Michael E.
