ORDER granting DE 63 Motion to Appear by Telephone/Video. Erin Blechschmidt, Esq. (counsel for Defendant) is excused from attendance at the 8/26/2026 Status Conference. Additionally, the Court has reviewed the hard copy of Defendant's privilege log which contains extensive detail, but it is missing any information about the job titles of the numerous individuals identified in the documents over which Defendant claims privilege and fails to identify which individuals are lawyers. As such, the Court cannot evaluate Defendant's privilege claim in its current incomplete form, as it is Defendant's burden to support its privilege claim. See Norton v. Town of Islip, No. 04-CV-3079, 2017 WL 943927, at *2 (E.D.N.Y. Mar. 9, 2017) ("The burden of establishing the elements of the purported privilege rests on the party asserting the protection from disclosure."); see also Bowne of New York City, Inc. v. AmBase Corp., 150 F.R.D. 465, 471 (S.D.N.Y. 1993) (holding that "if the party invoking the privilege does not provide sufficient detail to demonstrate fulfillment of all the legal requirements for application of the privilege, his claim will be rejected."). In the event that Defendant continues to seek to assert privilege over the documents contained on the log, Defendant shall file by 8/21/2026 a supplemental submission providing the job titles of all individuals identified in the documents over which Defendant claims privilege and identify which individuals are lawyers.
