Order on Motion for Leave to Electronically File Document under Seal
ORDER provisionally granting in large part 528 , 529 , 530 Motions to Seal Concerning Certain Summary Judgment Motion Briefs and Exhibits. Since the parties agree that Exhibits B-27, B-29 and B-84 should be publicly disclosed, the motion to seal is denied as moot as to those exhibits, but is otherwise granted. The parties shall re-file those three exhibits publicly. The parties are advised that information contained in the sealed documents may ultimately be publicly disclosed so that the rationale of the Court's decision is publicly available. The final decision on whether to maintain these documents under seal is reserved for the District Court after deciding the underlying summary judgment motions. See Church & Dwight Co. Inc. v. SPD Swiss Precision Diagnostics, GmbH, No. 14-CV-585, 2014 WL 7238354, at *4 (S.D.N.Y. Dec. 19, 2014) (provisionally granting redaction requests while reserving the right to "revisit [the court's] decision... following the resolution of the present dispute or upon request"). Ordered by Magistrate Judge James R. Cho on 5/15/2024. (JDP)
