MINUTE entry before the Honorable Matthew F. Kennelly: Video motion hearing held on 8/12/2026 regarding defendants' motion for clarification or bifurcation. The Court reaffirmed that it did not grant summary judgment in favor of plaintiffs on the "568 exemption" defense and also declined to entertain any further requests for summary judgment for the reasons stated at the hearing and in light of the long-ago expiration of the time to file dispositive motions. The remainder of defendants' motion for clarification (which amounts to a motion in limine) or alternatively for bifurcation is entered and continued for the reasons stated on the record. The jury trial start date is moved to 11/4/2026 at 9:15 a.m. The parties are directed to file by 8/24/2026 a joint status report regarding the scope of sealed filings going forward. The joint status report may be filed under seal if need be. The case is set for a telephonic status hearing on 9/4/2026 at 1:15 p.m. The following call-in number will be used for the hearing: 650-479-3207; access code 2305-915-8729. Persons granted remote access to proceedings are reminded of the general prohibition against photographing, recording, and rebroadcasting of court proceedings. Violation of these prohibitions may result in sanctions, including removal of court issued media credentials, restricted entry to future hearings, denial of entry to future hearings, or any other sanctions deemed necessary by the Court.
