Intel Shareholder Suit Against Execs Tossed

Law360, New York (June 05, 2009, 12:00 AM ET) -- A federal judge has dismissed shareholder derivative litigation that accused Intel Corp. executives of putting the company in the crosshairs of angry consumers and antitrust watchdogs across the globe.

Judge Joseph Farnan of the U.S. District Court for the District of Delaware on Thursday granted the executives' motion to toss with prejudice the shareholder's consolidated amended complaint. He said plaintiff Martin Smilow had failed to demonstrate that any prelitigation efforts to demand action by the company's board would have been futile.
