Law360, New York (September 01, 2009, 3:57 PM ET) -- Defendants in multidistrict litigation over alleged price-fixing by hydrogen peroxide manufacturers have moved to dismiss a complaint filed earlier this year by Kansas chemical company McShares Inc., saying that McShares' claims are time-barred.
In a motion filed Friday in the U.S. District Court for the Eastern District of Pennsylvania, FMC Corp., Eka Chemicals Inc., Akzo Nobel Inc. and Solvay Chemicals Inc. asked the court to dismiss McShares' complaint, which was filed in February in a Kansas court and subsequently transferred to the MDL in Pennsylvania....
